Ecclesiastical act of August 27, 1778, issued at Lucca, by which Giovanni Benedetto from Borgo a Mozzano is canonically appointed and confirmed as titular of the benefice or canonicalate of Saint William (San Guglielmo) in the church of Saint James (San Jacopo) in Borgo a Mozzano, with the associated income and rights. The document bears the authentic seal of the then archbishop (see photos). A brief impression of the text on the act? I have translated it for you: Giovanni Ignazio Lippi, priest, doctor in both laws, archpriest of the cathedral church of Lucca, as well as [Vicar-general] of the most worthy and illustrious lord Martino Bianchi, by the grace of God and of the Apostolic See archbishop of this Holy Church of Lucca, [and further titulature], to the reverend in Christ lord Giovanni Benedetto [Benedetti], son of the late Domenico Benedetti, from Borgo a Mozzano, priest of this diocese of Lucca, beloved in Christ, salvation in the Lord. The propriety of your conduct and the other laudable merits of integrity and virtue, upon which by Us, upon credible testimony, recommendation has been made, move Us to be favorable toward you; and what We see that can serve your welfare and benefit, We willingly grant you in the Lord. Wherefore, a certain simple ecclesiastical benefice, to wit, an perpetual chapel endowed under the title and invocation of Saint Willem [San Guglielmo], erected in the canonical church of Saint James the Apostle in Borgo a Mozzano, is now vacant, by reason of the deprivation [privatio] of the reverend lord Giovanni Battista de Marianis, the last and immediate holder/titular of it, and since with regard to this vacancy [a canonical provision follows concerning whether the vacancy has arisen within or outside the Roman Curia], and since by virtue of a previous instrument/deed dated January 1, 1707, as well as by virtue of the founding and endowment of the aforesaid benefice or chaplaincy, the right [of nomination/presentation] at the creation of such vacancy belongs to the competent community, and more specifically to the Council and the representatives/residents of the Community of Borgo a Mozzano, acting through their duly appointed deputies and procurators, and since they, using their right of nomination [or presentation], have nominated and proposed you, the aforesaid Giovanni Benedetto, for the mentioned benefice or canonical, and proposed you, and since the documents relating thereto and all required papers and evidence have been duly laid out and presented, [also after the remaining formalities required by law were fulfilled], and after We have knowledge of the rightful nomination/presentation and of what was laid before Us in this regard, we approve you, we instituted you canonically and we confirm you in the said benefice or canonical, and grant to you this benefice or canonical with all and each of the fruits, revenues, incomes, rights and emoluments attached thereto, as well as with all other rights and appurtenances that by virtue of the foundation, custom or law belong to it, so that you may lawfully receive and accept this benefice or canonical, and receive and enjoy its fruits, incomes, revenues and rights, in accordance with what the law and the foundation permit to the rightful titular of it. And by means of this current act we charge and command those to whom this belongs, and in particular to [the competent ecclesiastical and/or local officers], that they place you, or a procurator lawfully appointed by you acting in your name, in actual possession of the mentioned benefice or canonical, in the aforementioned [canonical/parochial] church of Borgo a Mozzano, and allow you to obtain the possession and enjoyment of the attached fruits, incomes, rights and emoluments, and that they, after you are thus placed in possession, maintain and defend your peaceful possession and enjoyment of it, and not allow that you be unlawfully hindered, harassed or perturbed therein by anyone, but that they ensure that you can freely and lawfully exercise, receive and enjoy all rights, fruits, incomes and benefits attached to this benefice or canonical by the foundation and the law, [keeping the rights and obligations arising from the foundation and endowment]. And We command each and every person to whom this belongs, under obligation of obedience [and according to the church jurisdiction specified in the act], to acknowledge and observe what has been determined above and to ensure its compliance, without allowing any action to be undertaken against it or that the aforementioned Giovanni Benedetto be disturbed in his legally acquired possession. As a witness and for confirmation thereof, We have drawn up this act and caused it to be sealed with the ordinary seal. Given at Lucca, from the archbishopric palace, on August 27, 1778.
